Terms & Conditions

These Terms & Conditions are based on the commercial license terms for the Pimcore Content Migration Bundle. They summarize the applicable license framework published with the software. In case of doubt, the full commercial license documents and any written commercial terms, offer, or invoice remain authoritative.

Scope and Customer Group

These terms apply to the software package dennispansegrau/pimcore-content-migration-bundle, including related source code, documentation, assets, and updates.

The software is intended exclusively for business users and entrepreneurs within the meaning of Section 14 BGB. It is not offered to consumers.

Evaluation License

You may evaluate the software free of charge for twenty-eight (28) calendar days starting on the date it is first installed, downloaded, delivered, or otherwise made available to you.

During the evaluation period, internal testing and review are permitted, including use in development, staging, and production environments for evaluation purposes.

During that period, the software may not be resold, sublicensed, rented, leased, distributed to third parties, used unlawfully, or used beyond the evaluation period without a valid paid commercial license.

Paid Commercial License

Any continued use after the evaluation period requires a valid paid commercial license issued by the licensor.

Unless expressly stated otherwise in separate written commercial terms, a paid license is required for continued internal use, production use, use on behalf of clients, and redistribution as part of a commercial service or deliverable.

The exact scope of the license, including metrics, number of projects, environments, duration, support, maintenance, and fees, is defined in the applicable offer, order, invoice, quote, or other written commercial terms.

Unless separate written commercial terms state otherwise, one paid license covers one legal entity or company.

Restrictions

Except where mandatory law prohibits such restriction, you may not copy the software beyond what is reasonably necessary for permitted use, backup, and deployment.

Redistribution of the software or modified versions is not permitted unless expressly authorized in writing.

You may not sublicense, sell, assign, transfer, commercially exploit, remove notices, or alter proprietary markings except as expressly authorized in writing.

Intellectual Property

The software is licensed, not sold. All rights, title, and interest in the software, including intellectual property rights, remain with the licensor and its licensors.

No rights are granted except those expressly stated in the applicable license terms and written commercial documents.

Updates and Support

Unless expressly included in separate written commercial terms, there is no entitlement to updates, upgrades, maintenance, support, or hosting services.

Customer Responsibilities

The customer is responsible for proper use of the software in its own technical and organizational environment.

Before productive use, and before running migrations or other operations that may modify data, the customer must test the software appropriately where reasonably possible, verify generated or executed migrations, and create current restorable backups.

The customer remains responsible for project-specific configurations, deployment decisions, safeguards against data loss or unauthorized access, and review of generated migration code.

Warranty Disclaimer

To the maximum extent permitted by law, the software is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

In particular, no warranty is given that the software will be uninterrupted, error-free, or fit for a specific purpose.

Liability

The provider is liable without limitation for intent, gross negligence, injury to life, body, or health, and under mandatory statutory liability provisions.

In cases of ordinary negligence, liability exists only for breach of a material contractual obligation and is limited to the foreseeable damage typical for this type of agreement.

To the maximum extent permitted by law, liability for indirect damages, consequential damages, loss of profit, loss of revenue, loss of savings, loss of goodwill, and data loss or corruption is excluded unless such limitation is prohibited by law.

To the extent permitted by law, total aggregate liability is limited to the amount paid for the software in the twelve (12) months preceding the event giving rise to the claim, or EUR 500 if no fee was paid. Any contributory fault of the customer will be taken into account.

Termination

The license terms terminate automatically if you breach them.

Upon termination, you must stop using the software and delete all copies in your possession or control unless continued use is covered by a separate valid written commercial license.

Governing Law and Jurisdiction

German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG), excluding conflict of laws principles.

To the extent permitted by law, the courts of Hamburg, Germany have exclusive jurisdiction over disputes arising out of or relating to the software or applicable license terms.

Entire Agreement and Contact

The applicable commercial license together with any written commercial terms issued by the licensor forms the entire agreement concerning the software.
